Terms and conditions

1 – Inscritpions for the rides

a.  Taking into account of the reservation

A registration is valid for 1 person and 1 motorbike. A contribution of 5 € will be requested for each additional motorbike.

As soon as we receive your payment, an automatic email will be sent to you to confirm your registration.

Payment by credit card is instantaneous as opposed to bank transfer which can take several days.

Payment must be received within 5 days of booking or the booking will be permanently cancelled.
(A payment reminder email will be sent after 3 days).

In the case of a full event, the first payment received will have priority over any other payment.

Please note: unless you have an error in your email address or a network problem, any driver who has not received this confirmation email will be considered as not having registered for the event.

b.  Invalidity

The following are considered invalid :

• Reservations not paid for and not collected 48 hours before the event.
• Reservations for which payment has arrived less than 48 hours before the event (*).
• Grouped bookings with a single payment for which the complete identities and levels have not been provided.

(*) In the case of a late payment, the pilot who arrives at the "Welcome" on the day of the event will be able to claim his reservation by handing over the bank proof of his payment. He will not be included in the registration lists of the day as he does not fall under the general conditions of validity of registration. His/her registration may be effective depending on the availability of places in his/her level group. If he/she is unable to ride, he/she may be given a gift voucher valid for one year.

c.  Withdrawal

Any driver who does not show up on the day of the event before 9:00 am at the "Welcome" without having previously notified the organizer, will have his registration cancelled without any possibility of reimbursement or carry-over in the kitty. His/her place will then be available for the requests of the day.

Conditions of cancellation of a paid reservation :

• Up to 20 days before the event
  Cancellation possible by email according to 3 options:
  • Postponement to an identical event that is not full,
  • Postponement in the kitty exempted from 30 € for administrative costs,
  • Possible replacement by a rider of the same level.
• Less than 20 days before the event
  No cancellation or postponement possible but possible replacement by a rider of the same level:
  • You find a replacement. You will then have to provide us with his contact details in order to proceed with the modification of the registration. To do so, he/she must have created a profile on our website. This person will arrange the payment with you.
  • We find a replacement. We will proceed to the modification of the registration and we will pay you the amount of the registration in your kitty with an administrative withdrawal of 30€.
• Covid-19: MRS cannot be held responsible for cancellations due to quarantine or border closures, there will be no refunds.

Cancellation/Interruption Insurance:

• As an alternative to these conditions and at least one month before the ride, a cancellation/interruption insurance can be taken out with our insurance partner Assuracing.

d.  Waiting list

When an event is full, it is possible to register on the waiting list.

If a place becomes available, a replacement will be found according to the following criteria :

• the date of the reservation,
• the level sought,
• the amount available in the kitty for a "last day" replacement.

Participation is not guaranteed, the Mertens Riding School is the only authority that has the power to decide on the choice of replacement.

The successful reservist will receive a payment notice or will be automatically enrolled if the requested amount is available in his/her kitty.
He/she will then receive a notice of confirmation of registration by e-mail.
Any request to cancel this registration will not be accepted.

However, it will be possible to register on the spot, depending on availability on the day and subject to payment of the pre-sale rate plus a €20 administration fee.
Applicants will be received in the order of their arrival.

e.  Groups by level of experience or pace

Four level groups are formed according to your personal criteria. The number of groups can be modified according to the number of participants.

A re-enactment is planned for the afternoon. Any pilot invited to change group will have to comply with this request or be denied access to the track.
In any case, if no level information is known by the Mertens Riding School, the rider will be placed in the slowest group.

f.  Noise pollution

The participant commits himself to respect the sound limit standards imposed by the circuit. The original exhaust system is required, otherwise a "dB killer" must be fitted. The noise standards are listed on the circuit websites. (https://www.circuit-mettet.be, http://www.spa-francorchamps.be)

As of 01/01/2020, the limits of 94dB static and 101dB dynamic are generally applicable.

Complete engine silence must be observed before 9 a.m., from 1 p.m. to 2 p.m. and after 6 p.m., including in the paddock.

The organiser may exclude at any time a participant who presents a motorbike with technical defects (tyres, brakes, noise, oil leaks, etc.) without any refund or carry-over in the prize fund.

2 – PAYMENT

a.  Authorised methods of payment

• By bank card, credit card or bank transfer: you will be redirected to the secure payment service MultiSafepay (the bank transfer details will be displayed).
• In cash on site, the price of the ride is increased for administrative costs (see price indicated at the "Welcome").

b.  Requesting an invoice

Invoice requests can be made online via the booking form (fill in the invoice details). The invoice will be sent 10 days after the corresponding event.
Alternatively, it can be sent by email within 10 days of the event without charge. After this time, any late request will be accompanied by an administrative charge of 30 €.

c.  Terms and conditions

Our invoices are sent within 15 days of the event. Our invoices are payable within 15 days of the date of issue. Failure to pay on the due date will automatically and without notice lead to interest of 1% per month from the date of the invoice and the amount will be increased by 15% with a minimum of €150 as a fixed compensation for extrajudicial costs. Any dispute regarding an invoice must be sent to us by registered post no later than 8 days after the date of issue. In the event of a dispute, only the courts of Neufchâteau are competent.

3 – SECURITY

Access to the paddock is reserved for participants. The speed limit is 10 km/h. Accompanying vehicles must remain in the upper parking area.

In the pitlane, the speed limit is 30 km/h. Smoking is not allowed. Children under 15 years of age are not allowed unless accompanied by an adult. Animals are not allowed.

The organizer cannot be held responsible for any accidents that may occur to users (pilots or accompanying persons), either physical or material. He will not be responsible for thefts or disputes arising between users within the circuit, track, pitlane, paddock, car park, office...

It is forbidden to bring in and/or consume alcohol or drugs. Non-compliance may result in exclusion.

The organiser reserves the right to interrupt the progress of the participants at any time for safety reasons.

Only photographers with a valid press card are allowed to circulate around the circuit. They will have to sign a waiver upon arrival. They must wear a fluorescent vest.

4 – MATERIAL DAMAGE

Any damage caused by a participant or his accompanying persons within the circuit - as regards the enclosure, the infrastructure as well as the track and its accessories - is at the participant's expense.

If you receive a transponder, you are responsible for it. The transponder must be correctly fitted. In case of loss or defect, a fee of € 400 will be charged to the driver. This amount must be paid immediately. By registering, you accept these conditions.

5 – FORCE MAJEURE

If, for a reason of force majeure (bad weather, incident on the track or unexpected), one, several or all sessions of the event should be cancelled, the participant undertakes not to claim any compensation or reimbursement or carry over in the kitty from the organiser.

6 – PARTICIPANT'S CHARTER

I undertake to obey all indications by signals and/or flags. Failure to do so may result in exclusion from the event.

I undertake to attend the compulsory briefing at the beginning of the event. If I have not been able to attend this briefing, I will have to attend another briefing with an instructor before taking to the track, at the risk of missing the first driving session.

At the end of the briefing, you will be given a wristband or sticker. No distinctive sign = no access to the track.

I agree to wear back protection every time up the track.

I accept the risks inherent in driving a motorbike or a car on a circuit without being able to take any action against the event organiser, whether I am injured by myself or by another person present on the track (signaller, photographer, marshal, trainee, service staff or other).

I declare that I am aware that only a first aid post with 2 nurses, an ambulance and a doctor will be available during the events.

I declare that I am physically fit to drive on the circuit.

I declare on my honour that all the information provided on the registration documents is correct.

I declare that I am registering with full knowledge of the risks involved.

I undertake to complete and sign the waiver on the day of the event at the latest.

I release the organiser from any criminal or civil liability in the event of any personal injury or material damage that may occur during the events. In the event of a dispute, the courts of Neufchâteau shall have sole jurisdiction.

7 – KITTY

The amount accumulated in the kitty must be used within 2 years. Once this period has elapsed, this amount can no longer be claimed.

8 – GIFT CERTIFICATE

It must be deposited in the kitty within 12 months of its issue date. No refunds are possible.
